The Research Of Legal Principle In Chinese Anti-Doping Punishment System

For many years,many international organizations and the Olympic committees of many countries have bended themselves into the undertaking of anti-doping,not only because doping is the violation of fair play and regular competition routine,but more importantly,the using of doping will seriously damage the athletes' health and wellbeing. Before 1980s,the concern of doping in our country was disregarded.Along with the more and more communications with foreign countries,the athletes started to step out of the country and engaged in international competitions more frequently,and the problem of doping came to stay in China.How to solve the problem brought by doping so that to chop this "cancer" out has become the most urgent task right now.After seeking and managing for more than 20 years,the anti-doping task in our country has made tremendous achievements and won world wide applause.In 2006,China has signed on the ,the legal obligation of this signature demands the Chinese anti-doping task must be in line with international norms.For many years,our national sports organizations have managed doping affairs mainly with "administrational strategies",in the lack of punishment procedures and regulations.Thus,the anti-doping task of our country cannot keep in line with international norms,and our athletes may be at a disadvantage in international sports disputes for not knowing how to use the regulations effectively. Therefore,in the hope find out the weakness in our anti-doping punishment system,this paper makes a comparative study of the anti-doping legislation and its framework from our country and international norms.The author suggest that the punishment system should contain two parts:trail and judgment,the former is to use the substantive law to convict the violaor of the law,and the latter is to use the adjective law to measure the punishment.But in the affairs of our county,usually the situations are "towards substantive,against adjective" or "towards punishment,against remedy",the lack of legal principles in punishment is the problem in anti-doping affairs of our country.Based on this,the paper chose punishment system as a breakthrough point in the hope of do my humble part of peace to provide effort for solving this problem.
