2008 Olympic Game will be held in Beijing. This provides us a good chance to pay attention to and study it. The legal attributes and status of International Olympic Committee and National Olympic Committee hasn't been defined clearly. This brings a series of contradiction and disputes. This isn't beneficial for the development of Olympic cause. This article primarily studies the status of IOC and NOC as two important actors in Olympic Game, and analyzes the legal relation of them under a new frame. This study tries to provide some theoretical support which can contribute to the development of theories of international law and Olympic Movement.IOC is a community setting up according to private law of Swiss, and it has the supreme status in the Olympic system. IOC has following attributions: the globalization and universality of its actions,important status in international communication. So we should admit IOC as an international legal person according to the functional principle and the private international law.NOC is a legal entity within a sovereign state, and have different kinds under different national systems. It is an important member in the Olympic organizational system, which abides by Olympic Charter, represents IOC to execute function and subject to the IOC's authority. If NOC has the status of international person, it is good for the management of relation between NOC and other subjects of Olympic. This is also a problem the article tries to study.Olympic Charter is the"Basic Law"of Olympic Movement, so all the subjects should abide by it. As far as the regulation of the relationship between IOC and NOC, the Charter also has some institutional limitations. This isn't beneficial for the rationalization of their relation. So it is necessary to regulate their relationship by rule of law on the basis of private international law, and advance the development of Olympic Movement.
