In recent years, Chinese privately-run schools have obtained gradual attention and a certain degree of development under the guidance of 16-character principle "active encouragement and strong support, correct guidance and vigorous management". Although the Law of the People's Republic of China on Promotion of Privately-run Schools in 2002 and Private Education Promotion Law Ordinance in 2004 have come out, the expectation of great development in privately-run schools hasn't realized. The reasons are complicated, among which the problems existed in the process of drawing up the policy on Privately-run Schools should be on the top, therefore, it's rather necessary for us to study the process of setting up privately-run schools policy reasonably and deeply.It took 8 years to draw up the Law of the P.R. of China on Promotion of Privately-run Schools and Privately-run Schools Promotion Law Ordinance. It's mainly because of some difficult decisions of key problems such as "reward reasonably" and"property rights" .The privately-run schools policy formulation process generally can be summed up as five stages: the establishment of policy issues, the setting of the agenda, designing of the program and proving its feasibility, making of policy decision and legalizing of the policy. The whole process reflects an organic combination of progressive and the political process of "top-down" and" bottom-up". There are some problems in the policy formulation process of privately-run schools policy, such as the policy objectives are too rational, the inconsistency of policy value orientation, the low level of democratic decision-making policy, the shortage of creativity in local policy formulation, and so on. If these problems in the policy formulation process cannot been dealt well with, it will affect the implementation of the policy effect in practice which will have influence on the sustainable development of privately-run schools eventually.Therefore, the promotion of the sustainable development of privately-run schools should be taken as the guiding ideology and the ultimate goal. Meanwhile, we should improve the democratic level in the process of setting up policy and strive to make scientific decisions. While dealing well with the issues mentioned above, local privately-run schools policy makers should pay attention to its target, application and operation based on the needs of the local privately-run schools development.
