Research Into The University Regulation System Under The Circumstance Of Government By Law

The university regulation system governing students has brought about a new round of revolution since its implementation and operation in 2005. How to practice the new regulations and restructure the students' rules maintain a key task for the university management. Although the university holds a correct objective of teaching students and fostering talents, it doesn't mean that the method to realize such objective is also legitimate. Once the regulations are outlawed, the students' legitimate rights and interests will be jeopardized. As far as the current situation concerned, when working out and carrying out the new rules and regulations, the university leaders always focus on the demand and objective of management, putting more emphasis on its order and efficiency while ignoring its procedure, justice and the protection of the students' legitimate rights and interests, which result in the violation of the students' legitimate rights and interests constantly. These legal disputes require us to make a response under the circumstance of government by law.This essay first reviews the legal position of university, the legal relation between university and students as well as the legal definition of university regulation. Secondly it ana(?)yzes and investigates the text of the current university regulations on the basis of the most influential four newly-revised texts selected from ten sample universities. Meanwhile, it conducts further research into the norm, content, operation and other rights of the text of the university regulations by means of documentary research, case investigation, text analysis, and mutual comparison. Finally, this essay makes the suggestion that the university regulations should be restructured in terms of concept, content, procedure and law so as to realize the combination of order and freedom, game of legitimacy and rationality, balance of right and obligation, alternative of restriction and protection. This essay is aimed to provide basis for the perfection of the university regulations so that the students' legitimate rights and interests can be better maintained. Through further regulating the managerial work in university, we can implant in the depth of mind the concept of governing university in accordance with law and govern universities in a better way.
