University is considered to be one of the most important organizations of a modern society; its social function goes beyond education and research, coming into indispensable relation with society and economy. Being one of the most important product of scientific research, patent has been the most important indicator of a countries scientific innovation. So how many patents the universities produced exerts a significant impact in a country's innovation capacity and its sustainable development.Starting from the theories of the patent system and the national innovation system, the article makes a vertical and horizontal comparison study of patent data to find out the strength and weakness of universities innovation capacity and also carried out the status and role of universities among national innovation system.At last, some concrete measures are set forth. The aim of these measures is to increase universities science & technology innovation capacity and exert more important role in national innovation system.
