The institution is the important resource of moral education. Facing the moral education effectiveness low situation on the process of social transition, we can take use of the institution to solve it. This article tries hard to study the legalist school's "the rule by law" thoughts and modernize them, then discusses how the legalist school's "the rule by law" thoughts have inspired the modern moral education and the moral reconstruction in the reforming society.The article mainly includes three parts:In the first part, the writer summarizes the legalist school's representative works and characters, the thoughts classification and their theoretical background. The article also introduces the contents of the legalist school's "the rule by law" thoughts, including the legislation, the law enforcement, and so on. At last the writer gives an objective evaluation to the legalist school's "the rule by law" thoughts.In the second part, the legalist school's "the rule by law" thoughts have the unique moral implication. The thoughts have two sides influence to modern moral education. From the opposite side they alert us to cultivate students' harmonious personality through strengthening the emotional education. Amending the institution's value foundation, we must establish the reliance upon human beings institution value. We also should overtake the limitation which the institution opposes to the moral and integrate the institution with moral. From the positive side, the legalist school's "the rule by law" thoughts enlighten us to fully utilize the institution resource in the moral education. The institution restricts people's behavior and builds the moral education external environment through the institution implementation. We should put the moral education beginning lower than before, and attach importance to the relation between benefit foundation and moral education. The moral education should have innovation spirits and expand its connotation further in the reforming society.In the third part, from the citizen moral angle in the reforming society, we emphasize the key which reconstructs the social moral is the institution safeguard system. We should institutionalize the basic moral standards and unify the right and the duty of the institution, then introduce the award and punishment mechanism into the moral domain. The school moral education should cultivate moral person with the instruction of the institution morality and foster people's rational rule consciousness. At last we should raise the students' moral autonomy spirits by constructing the citizen moral owner.
