Since 1990, as constant appearance of dispute about the right of receiving an educationin our country. the right of receiving an education has begun to attract the attention of jurists.More and more jurists begin to think about how to guarantee the educational right of citizensin our country by law. "Receiving an education" this constitutional right started from thetheory of human right set by Enlightners during the period of Western Bourgeoisie revolution.As bourgeoisie mounts the historical stage, westen countries strengthen their support to theeducation receivers through making laws and setting up public educational system, therefore,gradually it is legal to receive an education. After the foundation of our state, the right ofreceiving an education is also reflected in our nation's constitution and also standardized inmany branch laws. Since stting up of New China, our government attaches great importanceto education and has made great achievement. The legislation about the right of receiving aneducation is becoming more and more Refect, involving every aspect such as, bacic education,higher education, adult education, etc. Which guarantee the realization of the right ofreceiving an education of the citizens in our country. But because of historical and realisticreasons, the inequality in education reciving of the citizens of our country is still veryoutstanding.This article describes in detail the history of the development about the right of receivingan education theoretically. Combined with reality, it also analyzes how the unequal right ofreceiving an education of our country's citizens show itself in different ways, mainly asfollows, the unequal chance of receiving an education;the large gap existing in the unequalchance of receiving an education;ignorance and indifference to the right of disadvantagedgroups. The current situation of the citizens' unequal right of receiving an education in ourcountry. While what cna't be ignored is that our government's inequality of policy makingaggravates our citizens' unequal right of receiving an education. Analyzing from the aspect oflaw, public policy and reality, the four main reasons are as follows, the imbalance ofeducational resource distribution;the gap between the rich and the poor;the policy of thepriority of the city and the imperfection of our legal system. On the basis of theabove-mentioned research, this article has probed into the countermeasures of the realizationof our citizens' equal right of receiving an education, proposing to solve three importantmatters: Firstly, strengthen government's responsibility and financial insurance, in order torealize the equal chance of receiving an education;secondly, set up rational mechanism ofteacher' flowing, in order to realize the equal process of receiving an education;Thirdly,widen the way of relief progressively on the basis of perfecting legislation, in order to giverelief in time after the violation of the right of receiving an education, and guarantee the equalrealization of the citizens'right of receiving an education in our country.
