Since the State applied the system of appointment forprimary and middle schools' teachers, the laws regulate the rights and obligations of the education administration, the schools and the teachers. The schools and the teachers become a new kind of equal employment contract relationship. The laws regulate their rights, obligations and responsibilities. But there are many problems in the teachers' employment. For examples, their legal rights and obligations are ambiguity, and there are many problems in their employment agreements. These will be uncovered at the dismiss ion of the teachers. Unless we solve them, the issues will effect on the administration of the education services and the schools, and they can also impinge the teachers' rights. So we must analyze the issues, and find the methods to resolve them. As we all know that it is necessary to rebuild their legal relations and perfect the contracts. It also requires us to change the opinions of employment. According to the theory of Humanism, we must put teachers at the important position. Without teachers' development, our education can not have a long-term progress . The teachers must be given a high social and economic status. We can consult the other countries' experiences and set up a new system of teachers' employment, too. In this system, the education administrations are the employers and the teachers are the employees. The schools act as agents to manage the teachers. |
