The Government Regulation Of Private Schools: On The Perspective Of School Regulations

Starting from school regulations which is quite a unique point of view, under a relatively completive analysis structure such as why it can be regulated, what should we regulate and how to regulate, this thesis proof it logically from two aspects: theory and demonstration.In management circle of school education, this thesis first attempts to prove that school regulation is an important carrier of regulation conducted by government for the private schools. Because regulations have legal validity and contractual, and even a special advantage, and government use regulations to rule the private schools to be legitimacy and rationality. On this basis, according to the reference of axiology and its method to establish the private schools articles of axiology system regulation (justice, wertordnung and efficiency value), and put forward to raise the social and public interests is the starting point and the ultimate aim.Long-range regulations should clearly state what must be controlled, what ought to be ignored, which is the second basic question for regulations. This research proposed regulatory criteria stander from different angles, on theory levels: articles of law, external regulations standard which is stricter than internal ones, limited by market failure and incomes more than cost. On practice levels, the region of private school's regulations must be reflected in the regulations of no deleting absolute items. On the premise of statutory entitlement not equaling no deleting absolute items, in accordance with the regulations of incorporation and foreign schools, this research reelect the no deleting absolute items of private school: (1) school name; (2) location; (3) the school nature, school mission and the scope of business; (4) the election and authority of school board; (5) the resources of capital, the problems of charge, usage and reasonable return; (6) the micro provision and supervise of education quality. Theories finally should be put into practice. How the government regulations of private schools with school constitutions is the ultimate question to be solved. Through the investigation, interview, we've known practitioners'opinions of private schools toward school regulations, content formulation and implement of situation recently. Furthermore, the reduction of the function of regulations has been analyzed, and the realizable mechanism of private schools'regulation has been proposed: the government is one of mainly subject to formulated regulation of private schools; the structure of regulations have been adjusted into two aspects: absolutely necessary particulars and relative necessary particulars; form, unit and time of investigation should be optimized; government should estimate and supervise private schools in accordance with their regulations.
