Intellectuals are the brain and elite of the whole nation. As the important part of intellectuals, university teachers play an important role in economy, politics and culture.With the increasing diversification of society,talent's flow in market economy is certain demand to optimize the configuration of human resources.In educational fields, university teachers'flow is increasing sharply and teachers'flow is the focus problem.Teachers'flow is the social development tendency , which is necessary and inevitable,but university teachers'out-of-order flow influences the normal teaching order and goes against talents cultivation and research development. Because Xinjiang lies in the west of China,it falls behind other regions on economy ,culture. Teachers'drain is a common and serious problem in universities, it does not only threaten the good development of universities and educational work as well as the economic development of western areas. Paying attention to teachers'flow makes the author interested in studying university teachers'labor contracts, he hopes to regularize teachers'flow and provide useful references and help by means of building scientific teachers'labor contracts. This thesis starts with the background of university teachers'flow in Xinjiang, the author analyzes Xinjiang university teachers'labor contracts, choosing five public universities as the research objects, according to the nature of the work and characteristics of Xinjiang university teachers, linking theory with practice and studying Xinjiang university teachers'labor contracts very carefully. By getting contracts, agreements and regulations ,the author also talks to managers and teachers of universities ,aiming to learn about the current status of Xinjiang university labor contracts and build rational teachers'labor contracts and safeguard system.This thesis is divided into five parts:The first part: Introduction. The author mainly discusses research backgrounds, definitions, research review, research purposes and significances.The second part: The author mainly tells the theory foundation, including classical contract theory, Marx labor contract theory and new system economic contract theory.The third part: The author surveys and analyzes Xinjiang university teachers'labor contracts under the teachers'flow backgroundThe fourth part: The author mainly introduces the building of university teachers'labor contracts,including the principle and concept of teachers'labor contracts as well as the system which can insure it to run smoothly.The fifth part: Conclusion.The research indicates that because university teachers'labor contract has its defects, the teacher's implement consciousness and legal hindrance are weak and so on, it can't play an important role. Therefore, it is of important significance to teachers, universities and society that we build scientific teachers'labor contracts and perfect university teachers'management system.
