Discussion On The Type Of Juvenile Victims And Protective Measures

As it has generated for hundreds years, the research on the victimology started in nearly this 80 years. The disputed about whether the victimology should separate from the crime has ended by the side that agree the victimology should not independent won. In fact, strengthen the theoretical study of victims, can effectively reduce and prevent crime than just do the research on the offenders. In China, research on juvenile victims has just begun, its definition is also uncompromising, not unity. How to define the juvenile victim? How to probe a better way to protect the juvenile victim? These are issues what we have solved urgently.Focusing those questions above, this paper is divided into four parts: the definition and the classification, the reason, the process of bad inverter, the methods of prevent minors been offended.Firstly, we will define the juvenile victim. Although scholars tend to limit the scope of the study of victims within the framework of crime research, but we believe that victims of juvenile crime should not be limited to the concept of learning in the victim. It because that minors are dependent and weakness, they can not discern danger and can easily commit to crime. The process of the minor turn to be a offender is also a process of victim. Based on the particularity of minors as well as a more comprehensive study of measures to protect minors, the definition of the juvenile victim will wider than the victim in the area of crime. From this definition, the paper will classify the juvenile victim from the type of offensive, subject of the victims and different space of offensive, with a view to a comprehensive study of juvenile victim.The second part is about the reason of why minors are offended. We analyze this from internal and external causes. For the internal, is about victims themselves. As we know, victims have their own characteristics making them be a victim more easily. Minors are weakness, they need adequate attention and comprehensive protect from all over the school, the family and the community. Any leaks would turn minors to be victims.For the third part, we will discuss the process of bad inverter. Victims and offenders are not absolutely contradictory to each other, they can transform each other. We should pay more attention on juvenile victims in case of the bad consequence.In the forth part which is called the methods of prevent minors been offended. Author concluded three parts. First of all, we need to complete the law, so that methods can work well. Secondly, during the process of judicial we also need to show solicitude for minors'right. The last is about the whole protecting of family, school and the community. To construct a perfect guard to protect minors.Overall, this paper study on the juvenile victim from the point of students in the high and primary school, combined our own country to study it in a wide frame, tries to give some suggestions on practical problem solving.
