Research Of Legal System Of The Housing Fund Supervision

Since the 20th century 90 years, the housing provident fund system has established in China, and then it gradually replaced the previous welfare housing distribution system and played an important role in the transform of China's housing distribution system. It also promotes the development and improvement of China's housing system reform. However, the housing provident fund system has developed in several years, with the demand of house of urban residents has sharp risen in recent years, then the house prices have raised sharply. The housing provident fund system gradually exposes its shortcomings. In 2007, the U.S. sub-prime mortgage crisis which caused by the housing regulatory system shocked the whole world, then we have begun to right the housing provident fund control system in-depth exploration and research, with a view to draw lessons and accumulate experiences from the crisis, so that our housing provident fund system can able to truly realize its original intention, and then China's housing system can running in a stable and healthy development environment.To solve these problems, this paper describes the theoretical basis for the housing provident fund system. Then we give an assessment of our housing provident fund control system, primarily the presence of various defects in the current legal system; and then to Singapore, Germany and the United States of the related systems to gain enlightenment from these systems. The final part, against the previous questions, learning from foreign experience in related systems, proposed corresponding responses based on the legal dimensions of the concept:First, improve the housing fund system for monitoring legislation, the National People's Congress and its Standing Committee should establish and monitor a comprehensive legal system which can play a commanding role in the regulation of our housing fond system. Second, we must enhance law enforcement activities after the legal system has been improved. Third, the housing provident fund supervision should be vigorously publicized after the legal system to enhance its understanding, in order to the beneficiaries of housing provident fund——the community residents can better realize their own rights. Fourth, the subject of housing provident fund supervision should to be re-build to achieve the desired effects of regulation:In the first place, the decision-making positions of the housing fund management committee can be retained and strengthened, to really serve for the fund owners; Next, the housing provident fund management and operation department must be separate, set the Housing Fund Board to manage the housing fund, and then set up a special housing fund specialized banking operation; Finally, to establish a comprehensive supervision network in the whole nation, from all levels to achieve the housing provident fund supervision. To that enables the housing provident fund system can go further, continue to provide healthy and efficient service to the reform of China's housing system and economic development.
