Era of knowledge economy, the standard is playing an increasingly important role in the competition. Standards are playing an irreplaceable role in promoting of industry and technological progress, stabling and standardizing the market order, protecting the quality of goods.As everything has two sides, standardization is no exception, positive and negative effects exist at the same time. For example, the dominant enterprises can use the standards to exclude other competitors to enter and control the relevant market. Though it, they can seize high monopoly profits and seek self-serving.In China, we are short of the theoretical research on the standardization of the relative. In the international community, many large dominant enterprises have begun to use "standard" as a powerful weapon, taking a "technology patents, patent standardization, standard monopoly" road, in the hope of obtaining maximize profits through monopolization.This article is divided into six parts in total:Fragment. It tells us the background and research significance of this study.In Part two and part three, I summed up the standardization issues which leaded to a monopoly of the relevant market. I studied why they happed and what bad effect they have caused.The fourth section listed the European Union law and the United States law. The "EC Competition Law" is Subject-specific and clear. We can reference it when we draw up our law. The USA law established two principles. We can use them in our practice.The fifth section proposed a number of legislative proposals when we draft our law. And in the last part, I proposed a number of proposals in improving the standardization of our review system.The innovation of this paper is mainly reflected in:the content topics of innovation and research innovation. But I believe that with economic development, standardization issues are also enjoys popular support, there will be more scholars and legal professionals to be concerned about this and make more in-depth study.
