| Recently, frequency of China's food safety incidents gave a serious threat to the health and lives of citizens, caused great social panic, and obstruction to China's current rapid economic development. I believe that study on food safety management, is of significant value for the protection of public health and safety, stability of social and political order, coordinated development of economy and the eventual establishment of a harmonious society.The emergence of this phenomenon has a variety of reasons, but the major one is that China's food safety management system is immature, and food safety management legal system is not sound enough, and there are a large number of problems like, law enforcement chaoses, inadequate supervision, the lower level of effectiveness of legal norms. In order to strengthen food safety management, increase regulatory efficiency and reduce the incidence of food accident, I use a comparative analysis method, and make a horizontal comparison of the United States, the European Union, Japan, Germany and other countries on relevant information. At the same time, on the problems in food safety management, I make a empirical research through case studies and found the difference between the operation of legal rationality and legitimacy on food safety management. Finally, I work in the standardized research methods to found the lack of China's food safety laws and standards.First of all, I described the concept of food security and make an analysis of connotations. I raised the need of management of food safety, analyzed legal value of food safety management. The value of the order value as the basis of law is reflected in the food quality management and assurance and sanctions of the violations. From the people-centered point of view, the Government has increased food safety management, and emphasized the right both to subsistence and development. Finally, pointed out the benefits value of food safety management system.Secondly, make an analysis on problems of China's food safety management system. The construction of China's current laws and regulations is a lag, food safety monitoring system is a mess, lack of prior monitoring of food control, and the relief mechanism is not sound too. Reasons for these problems are that laws and regulations are not sound, and management system is not unscientific.Thirdly, make an analysis of developed countries of the legal system of food safety management from the perspective of foreign entry point. Make a horizontal analysis of the above mentioned problems in China's current food safety management system compared to abroad and give out the future direction of development. Raise the Construction of legal framework of a scientific food safety management system, and pay attention to the completeness of the convergence of law.Finally, give out the advice of amendment of China's food safety management system. From the whole, a complete legal system of management needs to improve on four faces, integrating existing resources, improving food safety management mechanism, and improving the food security of the litigation relief system on the basis of abroad experience. |
