Modernization and the development of architectural technology give birth to the Condominium Ownership. Condominium Ownership is a special form of real estate property right, it is a compounding right which is constituted by joint ownership and singleness ownership. Joint ownership can be deemed as the core of Condominium Ownership, and most disputes are deriving from it in real life. Though the property law has relevant regulation, it is not enough to regulate the legal relations of joint ownership.This article aims to study the basic issues of joint ownership. And it has seven parts. The first part is introduction, it shows the target, value and meanings of this article. Part two define the joint ownership, it discusses the existing theories of joint ownership and proposed author's point of view. Part three discusses how others countries cope with the subjective of joint ownership, and link them with China property law and proposes author's suggestions. Part four elaborates the rights and duties of joint ownership. Part five, which is the key part of this article, expounds the defect of existing joint ownership system, and, on the basis of utilizing foreign countries'advanced experience, author proposes some solutions. Part six discusses the legal responsibility of joint owner. Part seven, as the ending, points out that an integrated Condominium Ownership legal system should include the legal relations of joint ownership, and indicates that there is potential for legislature to perfect existing legal system.
