| Legal system for the building differentiation ownership is an important law system which was built in 19th century and grew bit by bit during more than 100 years. Now, we don't have a systematic legal system for the building differentiation ownership system in our century .In this article ,we divided four parts to study this theory and put emphasis on the common right of the building differentiation ownership.In the first part ,we analyzed the concept of the common right of the building differentiation ownership .Though it is an appurtenant right ,but it is complex and important ,In the article ,we elaborate the characters of common right and we know the relationship between the exclusive right and common right ,and we know the most important character of common right is coownership and shared ownership which can't be divided.In the second part, we elaborate the content of the common right and we elaborate the exclusive parts of the common right.In the third part, we elaborate the relationship between the common right and the based servitude, we know a law system must fit to the particular environment of our country, so we analyzed the definition of the based servitude.At last, in the fouth part, we analyzed the special parts of the common right ,and we display the deficiency of this system in the law.We want to get the general concept of the common right of the building differentiation ownership, and we hope we can build our own legal system for the building differentiation ownership in legislation. |
