Research On The Reasons And Countmeasures Of Rural Clan Force Crimes

As a product of feudal society in China, Clan once disappeared after the founding of New China.However, with the emergence of a power vacuum in rural community,clan begin to reconstruct in rural areas,and fully involved in the rural areas of political, economic and cultural lives.Clans activities conflict with state power and law,the problem of Clan crime turn to be more and more Serious.It posed a grave threat in building a new socialist countryside,and seriously affected the stability and development of rural society.Therefore, the systematic study of rural clan force crimes have great theoretical and practical significance.According to the present academic research on the revival of rural clans in our country,I re-limit the concept of rural clan force crimes. I use sociological methods by typical case to analysis social harm,crime types and characteristics of rural clan force crimes by typical case.Systematic structural criminal reasons theory has been used in analyzing the rural clans force crimes in our country. On the one hand, I analysis the social reason of rural clan force crimes from the relationship between clan forces and the power structure in rural areas.Because of there are three main networks to support the clan forces,clan forces become an important role in the rural power structure.First,clan economic support network, clans activities mainly protect the clan and its members economic interests and status in rural areas. Second, clan organizations support network,clan forces use the immaturity of rural grassroots self-government system to stop impact from State power to clans.They built a grass-roots Between clans and the state power by dominationing village and other grassroots organizations.Third, clan cultural support network,the basis of clan and rehabilitation is mutual recognition of the Members,so the establishment of clan culture in order to promote the clan growing has become a target in clans.the main reason of clan crime is that clan force want to struggle political,economic and cultural resources with state power.On the other hand, I analysis individual causes of rural clan force crimefrom the aspect of criminal psychology. Basing on the reasons for formatting the rural clan force crimes, I propose countermeasure against the rural clan force crimes. We should take measures from two aspects to prevent and control the rural clan force crimes:the first is the social countermeasures against the rural clan force crimes, including the development of rural democratic, the promotion of the market-oriented economy, the popularization of legal education, strengthen the management of social security.The second is the criminal and legal countermeasures against the rural clan force crimes, including the consummation of the criminal legislation and the completeness of the judicial system.
