The Conflict And Coordination Between Privacy Right And Freedom Of Speech On Internet

In our daily life, we often said:" we have not only obligations, but also have rights. We must assume responsibility, if we violate obligations." About this criterion, we have not realize it's meanings. With the popularization of the Internet, the space of expression to the general publice is become more and more broadness. At the same time, network speech also brings adverse factors, it happens some conflict with other rights of the general publics. Expecially, the conflict between the network speech and the right of network privacy.This paper is focus on the conflict between network expression and right of network privacy. And analyzes the contradictions, by one case, this paper also points out some questions in the modern information society. For example, how to coordinate the conflict of the network expression and the right of network privacy. How to protect the general public's personal life, in the basis of promoting freedom of the network expression. The paper is divided to three parts:The first part introduces the details of case, the judgment of our court and the different points of different people.The second part explores the analysis of case. First, analyzes the judgment of court, in the basis of the constituents of network tort. Second, states the legal thoughts to case. Including, the meanings of the freedom of network speech, the relationship and value counterparts between the network expression and the right of network privacy.last, this part gives a criterion to balance them.The last part introduces the realization of the right to freedom of network speech and the right of network privacy; states list in the network of legal provisions; discusses the advantages and shortcomings of the legal provisions to our country. Finally, the writer gives some suggesstions to balance these two kinds of value.
