| This paper focuses on the figures in laws, and in an empirical method, analyses the figure provisions of Chinese laws as what they are. An introduction and four parts of content constitute this paper. The introduction tells why I wrote this paper. We all know that there are many figure provisions in laws, but why they are there and how they come into being. The answers are the content of this paper, while the questions are the main frames and guide the whole paper to go on. In the first part, I sum up the figures in laws. From the features, content, types and some other aspects, I describe what are "the figures in laws "I mean to discuss and make them a independent, specific object that can be studied separately; Then, Part two is to answer why they are there, following the question of part one "they are there". What is the reason for figures existing in laws, and in such a great amount? This part provides an comprehensive answer from three aspects:law's frame, law's content and law's application in reality, telling that figures to laws are inevitable, essential and necessary. The third part aims to explain how the figures are fixed in laws, in another word, that is what reasonable basis behind the figures provisions is. An analysis on the figure provisions involved in our legislation and law's revision shows the factors that have been considers in the past to lay down or revise a figure in law. And also these factors are what should be considered in the future. Part four is the conclusion. Here, I uncover the subtle relation between figures and justice:In fact, the whole paper is about fairness and justice of law. Figures in laws are the manifestation of law's fairness and justice. The reasons for figures in law are because they are beneficial for the realization of fairness and justice. How to fix a figure is judged by whether it is reasonable to realize fairness and justice. We can see the title "laws in our countries" does mean this paper is to discuss the figures as they are. The aim of this paper is just to tell out the specific meaning of figures to law. Certainly, in the third part, my discussion involves a tendency of how figures should be fixed, hoping the factors I mentioned should be considered in the future legislation and revision.(if meaningful, propose a subject for other researchers.) If I can say so, these two are the tiny values of this paper. |
