The Reform Of The Current Petition System

As an important channel for political participation of citizens and a great way to relief civil rights, Inquiry System is a significant form to achieve and safeguard the democratic rights of the people. Inquiry System plays an positive and irreplaceable role of expressing mass's appeal, collecting social conditions and public opinions, resolving contradictions and maintaining social harmony and stability. With the acceleration of China's economic development and social transformation, many of the contradictions gradually intensify and appear, and the Inquiry System is facing austere challenge. The severe and complicated condition of the Inquiry System not only greatly testes the ruler's political wisdom and ability, but also puts forward the times proposition for social and science researcher. The Inquiry System reform has aroused widespread attention and theoretical research is continued, but there are grave deficiencies in these studies. Because the theory circle lack of political vision, political height, the front line experience and work experience, the theory research is far away the current political system and the basic national conditions, and the reform of the Inquiry System is too much idealistic. The Inquiry system workers of practice circle can't understand the deep connotation, so they simply think the definition of the Inquiry System reform are replacement and reform of the functional configuration and process reengineering, etc. This paper argues that the reform of the Inquiry System involves many aspects,such as the Inquiry System cultural construction, the Inquiry System functional location, the organization establishment of the Inquiry System, the perfection of the Inquiry System, the operation of the Inquiry System. So, from a macro, systematic and comprehensive theoretical perspective, using historical analysis, comparative political analysis and neo-institutionalism research methods, through the historical and international comparison, in combination with the social reality, this paper analyses the current condition, the major problems and the causes of the Inquiry System. In order to make the Inquiry System display new vitality and resolve the plight of the current Inquiry System, this paper presents the current and short-term measures and long-term measures for the reform of the Inquiry System. The short-term measures includes establishing reasonable operation and evaluation mechanism, rational location of the work institution and function of the Inquiry System, the problematical handing mechanism combated democracy with legal system. The long-term measures includes promoting the transformation of the Inquiry System culture, improving the legal system, strengthening the judicial function, establishing common ethical standards and continuing to deepen reform.
