| Liberty is one of the earliest right to be protect in modern times . Liberty, life and the pursuit of happiness have been called the inalienable rights of man in the American war of independence,and have been incorporated into the Declaration of Independence. In Western developed countries, Liberty is considered an important foundation for a democratic society ,and an important requirement for individual progress and development. Almost every country have declared to protect liberties in the Constitutions. our Constitution and laws clearly declared out of the protection of civil liberties. However, as a basic right of human, liberty is also limited. As a kind of right, liberty has its own limition. When we set up states, governments restrict our liberty. And this is unavoidable.This article aims to study liberty and its limition in the areas of constitutional laws . as a natural right, liberty has its limition before nation was set up. When human being came into the age of nation, government limits it too. In law category, laws restrict it, and this is obviously showed in Constitution. The core purpose of the Constitution is to protect civil rights, but not restrict people's liberty. As a result, the Constitution should not limit liberty freely. We must define the boundary for consitution to limit liberty. |
