Study The Constitutional Review System

Implementation of Constitution is the only way of managing national affairs legally and building a jural country with Chinese characteristics. But the constitution authority depends on the constant improvement of itself,furthermore,a legal system reflecting the spirit of constitution and achieving the law's application is necessary,and its core is constitutional review mechanism.With the development of the socialistic democracy,as the core of a national legal system,the constitution is showing its authority,therefore to establish an constitutional supervision is necessary hereby insure the status of constitution, to guarantee the constitution be respected by the whole society and be correctly implemented,to ensure the restriction on national authority by constitutionand to achieve the rights and freedom of the people.In this thesis,based on the fundamental polity National People's Congress and the current fact of china,the author analysed the constitutional review modes of other countries and the actuality of chinese constitutional supervision from theory to practice ,then raises a rational constitutional supervision ,that is to say, etablish a constitutional review committee under National People's Congress of china is possible.
