The Analysis Of Approach To Construct The Rule-by-law Government In China

With the establishing and developing of socialistic market economy,"ruling the country by law and building a socialist rule-by-law state"is already affirmed by China's constitution and the key to building a rule-by-law state is to build a rule-by-law government. If we focus on the current situation of rule-by law in our country and important role that government played in politics, economy and culture, building a rule-by-law government becomes the objective necessary of the current situation and future development. In order to offer some help for the construction of rule-by-law government, the author write the thesis on this subject.In the first part of the thesis, the author puts forward the question, pointing out that the issue that rule-by-law government proposed by learned men has a profound historical background, it developed on the basis of interaction between the state and the society, and building a rule-by-law government will further developed the process of China towards the rule of law. Then it introduces the research of this subject both at home and abroad, the thinking thread, means and significance.In the second part of the thesis, the author introduce the general theory of rule-by-law government. In the thesis the explain of the concept of rule-by-law government is to start from the concept of the rule of law, and then gradually leads to the concept of the rule-by-law government. The author firstly gives a summary statement on common theories of the rule of law, try to use historical and comparative analysis methods,introduce the acquaintance of the rule of law and rule-by-law government by scholar of China and western and development of the rule of law since ancient time. Next explain the value factor of rule-by-law government and the basic characteristics of rule-by-law government. The author discuss the rule-by-law government should be limited government, responsible government, honest government, service government, effective government and people oriented government. Finally the author raised the necessity of constructing rule-by-law government.In the third part of thesis, the author use empirical methods to analyze the existing problems in constructing rule-by-law government at this stage. The author analyze the existing problems in constructing rule-by-law government from three aspects, that is cultural traditions, the government itself and system level.Part four is the key part of the article. The author puts forward specific countermeasures to construct the rule-by-law government from six aspects, they are: Creating a favorable external environment for the rule-by-law government; Transforming government functions and deepen the administration system reform; Adhere to the people-oriented principle, improving the legal system of administration; Strengthening the administrative enforcement of law; perfecting our administrative supervision mechanisms; Promoting the civil servant's ability. Each part the author represent detailed, and pay attention to join the practice of our country.In the last part of thesis, the author point out that constructing the rule-by-law government in China can't be achieved overnight, it need a very long way to go, so we must make efforts on this subject.
