On The Government Of Rule Of Law In Contemporary China

The government of rule of law means not only the establishment, alteration, running of the government but also administrative lawmaking and decision etc must abide by law. There are laws to go by, the laws are observed and strictly enforced, and law-breakers are prosecuted. It is necessary and urgent to set up the government of rule of law in contemporary China. By investigating the history of the government of rule of law and analyzing its present condition, the author point outed its disadvantages. There is a series of ways to solve those: educate the administrative personnel the idea of rule of law; enhance and perfect administrative lawmaking; perfect the mechanism and system of supervision. In the lawmaking aspect, firstly, it is necessary to make the laws of government organization and the administrative personnel's management. Secondly, the government should put the law of the duty system into practice strictly and furthermore perfect the system of government duty; as a result the administrative personnel with the strong and big pressure will act according to the law. Finally the government work procedure should be legal. On the supervision aspect, it includes country supervision, society supervision and legal supervision. The country supervision includes organs of state power supervision, judicial departments supervision and administrative department self-supervision. The social supervision includes political party supervision, public opinion supervision and the masses supervision.
