The Penalty System Of Unit Crime

With the importance of the social economic intercourse, the proportion of unit crime is rising, especially in the economic crime. In this situation, how to restrict the trend and solve the embarrassing problem between the crime and penalty is an extremely important problem in the theory and practice. In our criminal law, the penalty of unit crime has not yet formed a rigorous system, and exists lots of flaws, such as the singleness , the severity of the penalty is not enough. So the existing penalty provision of the unit crime is difficult to adapt the increasingly serious economic crimes situation, Therefore, It is very urgent and necessary to build the penalty system of unit crime in our country. In order to adapt the reality of punishing and preventing unit crime, and implement the principal of criminal responsibility .This paper try to propose a legislative concept of building a juxtaposition of the person and unit criminal penalty, and design the relevant law at the end. That based on the basic study on Chinese criminal law and compare research on foreign criminal law.
