The equality is not only a constitution principle,simultaneously is also a basic right. Constitution of our country stipulated that the citizens of People's Republic of China are equal before the law,the state respects and safeguards human rights.The equality rights of employment are the concrete manifestation of the principle that all people are equal in front of the law.The workers should not been divided by the nationality,the race,the sex, the age,the family background,the religious belief,the financial condition and so on. They must enjoy the employment opportunity equally in the employment process,and do not receive the discrimination because of any reason except the working ability.At present,the protection of workers' equality rights of employment in our country generally did not achieve the ideal situation,the employment discrimination still widely existed,violations of workers' equality rights of employment take place frequently.The most common discrimination has the sexual discrimination,the household register discrimination,the health discrimination,the appearance discrimination,the age discrimination and the school record discrimination and so on.We are gratified that some workers have already put forward their own questions to the seemly reasonable rules,and start protect their legitimate rights and interests through legal means,and has aroused people's attention and thinking to the discrimination to height,health,age and so on,and has awakened citizen's right consciousness gradually.The awareness that people use the legal weapons to safeguard their rights becomes stronger and stronger.There are many reasons cause the protection to the equality rights of employment is poor in our country. Looked from the legislation,the reasons are the unscientific concept,the bad feasibility, the legal responsibility that has not been carried out as well as the existences of violations to the Equality Rights of Employment in the rule.We should learn the mature experience of the protection to the Equality Rights of Employment from other countries and regions,and consider the actual situation in China,to construct scientific legal framework to protect the equality rights of employment.
