| This paper analyzed the patent protection problem of business methods. In recent years ,more and more scholars in our country began to study this problem.Business methods bring huge profit now, so more country strengthen the protection of business methods. There are many discussions in the theory and practice. Since 1998, many business methods have been granted patents in United States.In our country, patent protection to business methods is still indefinite. The important thing is how to learn from the experience and lessons from the developed countries and how to propose China's national standards on business methods patent criteria.This thesis is divided into four chapters. The first chapter makes a brief outline on business methods. This chapter builds up a foundation discussion of the substantive conditions of business methods.In the second chapter, the author compares the judgment criteria in the United States,Japan and Europe. Then the author discusses the "three nature" of patent business methods. In the last two parts,the author analyses the necessity and the possibility of establishing of the business method patent system in our country. After this, the author makes up the construction outlines for business methods patent system. |
