With the promulgation of Circular Economy Promotion Law of the People's Republic of China, Extended Producer Responsibility (EPR) is displayed before the public again. In general, the responsibility of the producers to products happens in the stage of product design, manufacture, distribution and use. But producers who are benefit from the product have no responsibility for it when the product is at the end of the life cycle and becomes waste. The waste is usually discarded easily or disposed by the government. The system of EPR extended the responsibility of producers from traditional stage to the stage after the life cycle of the product. This system can improve the utilization of resources and can correct the unreasonable situation above. As far as the reality of our country, the resources will be depleted, which has become the "bottleneck" in the process of China's industrialization. The development of the circular economy which puts the reuse of resources as its core, embodies the request of scientific concept of development. The system of EPR is one of the most important systems to develop the circular economy. Therefore, it is necessary to make a deep study on the system of EPR, because it has important theoretical value and practical significance.By using the method of comparison, this paper first introduces the successful experience of the foreign countries and combines with the actual situation of our country. Secondly, with the hope of providing beneficial references for legislation and practices of our country, at the end of this paper, it provides some feasible measures on the extension of the system of EPR in our country.This thesis is divided into four parts except the preface and the conclusion.Part one introduces the connotation and theoretical of the system of EPR. Firstly this part analyzes the distinction and contact between the Producer Responsibility and the Extended Producer Responsibility, and introduces the origin of the Extended Producer Responsibility as a legal term form the level of legal continuity. Secondly, It introduces its definition, content and theoretical foundation.The second part of the EPR concerns on the legal system and the experience of practice in foreign country. Through introducing their successful experience, we can summary the important inspiration to our country.The third part is about the status quo of the legislation and practice in our country, from which we can find some defects in our legal system and in the field of practice. At the same time, it discusses the plight of the rule of law EPR is facing on in our country.Part four, with regard of how to break through difficulties and how to improve the system of EPR, there is some advice in this part. For example, to re-position producers, governments and consumers; to set up the incentive mechanism of EPR; to improve the supporting system of EPR; to enhance the awareness of environmental protection of the public, and so on.
