Study On Legal Issues Of Foreign Exchange Reserve Management

Foreign exchange reserve management is not just an economic issue,but also a worth-depth study legal issue.Improving the foreign exchange reserve management needs a set of sound legal system.At present,our country is in the period of foreign exchange system reform,and the legal rules for regulating foreign exchange reserve system is rare. With the continuous increase in foreign exchange reserve and the important role it plays among the whole financial system,the function of laws in the management of foreign exchange becomes even more important.To conclude and study present laws about foreign exchange reserve management has very practical meaning for the effective usage of laws in the management of foreign exchange reserve.This paper mainly adopts the methods of comparative analysis and evidence analysis to elaborate the author's points.On the view of macroscopic,this dissertation analyze the content of IMF guidelines for foreign exchange reserve management and compare the advanced experiences of foreign exchange reserve management in the world.On the view of microscopic,this dissertation explain IMF guidelines for foreign exchange reserve management from aspects of its principles,content, transparency and the responsibility of reserve management and so on.On the above premises,and the combination of the present situation of the management of foreign exchange reserve in China,this paper discusses the mode of China's foreign exchange reserve system,and provides suggestive ways to consummate legislation for foreign exchange reserve management in China.
