A Comparative Study Of Cyber Crime Between China And Korea

Cyber crime has become dangerous to the whole international community.Cyber crime has a quick and variability as well as the characteristics of the affects global community,making Cyber crime must rely on the concerted efforts of the international community.In 2001,in order to establish a system of international cooperation which response quickly and effectively to contral the Cyber crime,the United Nations has made a convention called the "Convention on Cyber crime",which established the principle and the specific measures to control Cyber crime in the whole,what's more,it requires each State Party shall take the necessary legislative and other measures to Cyber crime in its domestic law to determine criminal.China and Korea are all belong to continental legal system,and they are adjacent to the sea,therefore they have much in conmon on the punishment of Cyber crime,but there are also many differences.For help each other and promote each other,is more conductive to cooperation in the fight against Cyber crime and punishment,the paper selected for China and Korea the issue of Cyber crime legislation dissertation writing.The paper is divided into five chapters.The first chapter is an overview of Cyber crime,Cyber crime has been mainly on the concept,characteristics,types,and their reality.The second chapter is to compare the composure of Cyber crime between China and Korea,it enumerates the differences among the object of the crime,the subject of the crime,the objective of the crime and the subjective of the crime.The third chapter is about the subject to investigate and the prevention of the main mechanisms,and it analyze the problems about them respectively.The fourth chapter is to compare about the punishment of two countries,it compares with each other from crime law system,penalty rate,and the kinds of penalties.The fifth chapter probes on the legislation of China and Korea,it points out the defects of each country and according to the difference of national conditions and the actual situation,put forward some immature mind.For lacking of the knowledge on criminal law and also be limited on language,I just tried my best to express my idea about this theme,many places aslo need to study and work in the future to explore in-depth research,invite teachers respectfully to excuse me.
