The Protection Of Small And Medium-sized Enterprises In The Perspective Of Antitrust Law

Based on the careful research and the specific provisions of antitrust law theory,the purpose of this paper is mainly to discuss the protection of small and medium-sized enterprises with the antimonopoly law for the vision.This paper expounds the significance of medium and small enterprises,analysis of small and medium-sized enterprises to monopolistic conduct free participates in the market competition,discusses the relationship between antitrust law and the protection of small and medium-sized enterprises,enumerate the successful protection experiences of other national anti-monopoly legislation,and put forward my own views on the inadequacies.The first part of the paper is to analyze the necessity of protection of small and medium-sized enterprises.First of all,clearing the definition of small and medium-sized enterprises in China,explaining the huge role of small and medium-sized enterprises in the process of China's economic development by a series of data,expound the vulnerable position of small and medium-sized enterprises in market competition.The second part of the article is to analyze why the protection of small and medium-sized enterprises should be so from the perspective of the antimonopoly legislation value.The third part of the article is to analyze the real protection of small and medium-sized enterprises.In combination with the specific provisions of the anti-monopoly law,deduces the provisions of universality protection and special protection in the protection of small and medium-sized enterprises.In the last part of the paper,I will introduce foreign related experiences in anti-trust legislation,Summarize the insufficiencies of the antitrust laws in small and medium-sized enterprises protection,then puts forward several ideas According to the problems in the end of the this paper.
