A Study Of The Process Of The Establishment Of American Trademark Dilution Law

The theory of trademark dilution deeply influenced many aspects of American, including legislation and judicial practice. After many states enacting trademark dilution acts according to the theory of trademark dilution, the Federal Trademark Dilution Act was established in 1995 and later modified in 1999 and 2006.we can gain a lots of enlightenment and experience from studying the process of the establishment of these acts, especially, the 2006 revision of the Federal Trademark Dilution Act, which provides the proving standard and specific forms of trademark dilution. It surely can be used as an excellent reference in our own trademark dilution legislation. With the development of market economy, Chinese corporations have gradually realized the importance of trademark protection. With the enactment of relevant laws, more and more people appeal for enacting Chinese Trademark Dilution Act.In the hope of offering some valuable advice for our own Trademark Dilution Legislation, in perspective of history, I will examine the development of trademark dilution theory and its influence on legislation and judicial practice in USA in this article. The article consists of three chapters. Chapter one is about the history, concept, and the form of trademark dilution. Chapter two focuses on the development of the American states and federal trademark dilution legislation. Chapter three, based on summarization and analysis of Chinese relevant laws and regulations, puts forward some advice regarding our own legislation on famous trademark dilution.
