| In today's world, great importance is attached to the relationship between international trade and labor standards with the process of economic globalization, and turns the relationship between international trade and labor standards into a hot issue. While making slow progress in conducting the labor standards into the WTO system, the developed countries take full advantages of their economic and political influence to take unilateral measures and bilateral and multilateral free trade agreements which add labor standard provisions, as well as regional free trade which succeed in relating labor standards to international trade in a small area. These actions make progress on the link international trade to international labor standards. Meanwhile the voluntary labor standards sponsored by civilian organizations emerge quietly and developed rapidly, and provide a new way to the solution of the issue. Compared with the traditional labor standards, voluntary labor standards are more easily accepted by developing countries, and have broader range and scope, which allows voluntary labor standards go further than the traditional enforcement of labor standards. Now developed countries are concerned about the voluntary labor standards.In line with China's national conditions, China has abundant labor resource and lower labor costs, as well as the number of goods from labor-intensive industries is taking greater proportion of exports each year, making developed countries feel threatened by our exports and restrict imports from China. Therefore, China must face up the question of trade and labor standards in international trade system, research on the relationship between trade and labor standards is of profound theoretical and practical significance.This paper bases on the international practice of international trade and labor standards issue, analyses the mode of their linkage to research the question, and provides measures to the challenges.Chapter One is about the basic theory of the issue of international trade and labor standards, elaborate the meaning of the concept , such as international labor standards, core labor standards. Introduce the opinions and reasons of the developed and developing countries in the debate on trade and labor standards. And then analyze the link of international trade on labor standards, mainly from aspects of economic point and human rights protection.Chapter Two analyzes the practice of the traditional labor standards in the current national legislation and international legislation, and include the mode include the following: domestic trade law, Generalized System of Preference, bilateral trade agreement, regional trade agreement, Several illustrations were given to amplify how the mode impact of the labor standards into international trade. Finally developed countries' the efforts to bring international labor standards under the framework of the WTO is briefly introduced.Chapter Three is the introduction of the voluntary labor standards. Started from the Background, explain the meaning of the consumer movement and corporate social responsibility, then make an analysis of the consumer movement and exercise social responsibility in the promotion of the voluntary labor standards. Analyze the characteristics and main forms of voluntary labor standards. The main forms of the voluntary labor standards in this paper include product social responsibility label and codes of conduct, which can be divided into internal codes of conduct and external codes of conduct.Chapter IV is mainly about the conflict and coordination of international labor standards and the domestic law in China. Analyze the legal reasons why China encountering barriers in aspect of legislation and law enforcement, the legislation focus on the gap between core labor standards and China's labor legislation. The measure China should take is discussed at international and domestic levels, at the international level developing countries should stick together, at the domestic levels domestic labor legislation should be improved and the law enforcement of labor inspection should be strengthened, in order to protect labor rights and to improve international trading environment. |
