The Nationalism is the core conception of the Chinese tradition law culture,which belongs to the public law.Since the latter Qing dynasty,the national disaster had occurred repeatedly,just at that time,West's constitutional government thought spread to China in the sanguinary role.Under the new historical perspective,the Nationalism hadn't withdrawn from the historical arena,on the contrary,it had more and more vitality in thinkers' brains.Liang Qichao,Yan Fu who represent thought giant influenced by nationalism,had suspected and denied human rights and the freedom that is the essence of Western constitutional government.So our constitutional government construction has become a monstrous which is full of nationalism.This article mainly seeks the Western constitutional government thought how to disseminate at first in China;the latter Qing dynasty thinkers how to misread Western constitutional government thought by using nationalism;and those thinkers how to use nationalism to substitute the core value of constitutional government.At last,we make the sketchy analysis by the perspective of nationalism to the process of china constitutional construction.
