Study On Legislation Of Fishermen In China

Fishing industry take an important part in China's national economy,there are more than 40 thousand fishermen in China.Due to the special working circumstance, they always suffered higher adventure than the merchant crew,their work were considered to be one of the most dangerous work by ILO.But there is no corresponding laws or regulations to protect fishermen's basically rights.And most of the laws and regulations which can applicated by seaman are exclude fisherman.That is to say,such a group like the fishermen are under the black of protected by law.At this time ILO were passed the Work in Fishing Recommendation,2007.It is an international labor standard for the world of fishermen.This convention take some request to the members to take some measures to be sure this convention's protect fishermen's rights,especially in legislation level.as the one of the positive member states,china has take part in the establish of convention.Our government also said well pushes the authorizing in national society.Before the convention become operation in China,we should have the effect legal system to cooperate.Under this background,establish the fishermen law is a necessary and feasible object.This article in view of this situation,putting forward of this subject in fishermenlaw.Fist of all,definition the fishermen in my article.Secondly,introduce the Work in Fishing Recommendation,2007,and compared some countries and area's management of fishermen which have developed fishing system in the world.At last, suggest the feasible ideas for legislature mode of fishermen law.
