On The Cost-Effectiveness Evaluation Scheme Of Agriculture Legislation

Given present changes in the agronomy and the adjustment of industrial policies,agriculture is playing a fundamental role in facilitating economic growth and social stability.Under this background,agriculture legislation is increasingly vital to the sustaining of the fundamental status of agriculture in the national economy and promoting of a sound and rapid development of farm industries.Since 1978 when the reform and opening-up was staged,tremendous achievements have been made in agriculture legislation in China.There have been 36 laws and regulations formulated that remain effective today,and agricultural departments as well as local governments have also developed volumes of farm rules and norms,which shaped the agricultural legislative system that is led by the Law on Agriculture.Moreover,headways have also been made in areas like legislative theories,mechanisms,procedures and skills,which make it possible to rule the country by law.However,agriculture legislation still can't meet the needs of agricultural and rural economic growth in that some needy and vital bills and rules are waiting to be drawn,some existing ones are principle in nature but impracticable,legislative practices need to follow procedures,and legislative quality needs to be improved.The present development momentum poses higher demands on agriculture legislation,which relies on the quality and profile of laws to display its roles.It is scientifically based procedures and high quality dossiers that promise the guiding and facilitating role of farms bills and regulations.As cost-effectiveness evaluation scheme in legislature remains to be improved,plus that the relationship between legislative cost and effectiveness are no well handled,and that there are some problems such as "to make a law for the sake of the law",the number of laws overriding the quality of laws,etc.,valuable resources have been wasted, legislative quality and profiles compromised,and targets and objectives prevented to be realized.Therefore,legislative cost and effectiveness assessment scheme must be set up,and legislative system as well as quality be improved if to ensure that there are laws to follow and must be followed when problems appear in agriculture.Only by doing this can agricultural laws are enabled to steer the enforcement,promote economic growth,and maximize social benefits.With this taken into account,the study on the legislative cost-effectiveness evaluation scheme is of great significance.Based on theories of economic laws and legal economics,and having integrated quantative,qualitative and comparative studies,this paper centers on the issue of development and improvement of the evaluation scheme and focuses on the in-depth discussion of the three components of cost-effectiveness assessment,namely jurisprudence foundations,basic norms and indicator systems,on the basis of learning from practices and experience of legislative cost and effectiveness assessment in China and other countries.Its creativeness lies in that it takes into account both the economic and the legal characteristics of legislative activities on the theoretical basis of legal economics principles, developed an evaluation indicator system and carried out theoretical studies.It consists of three chapters in addition to introduction and conclusion.Chapterâ… describes jurisprudence theories in legislative cost-effectiveness evaluation.Firstly it elaborates on theories from four angles of jurisprudence,economics,legal economics and policies. Secondly,it analyzes achievements and problems in agricultural legislation in China.Thirdly,it describes the history and exploration activities of legislative cost and effectiveness evaluation at home and abroad,and finally,it analyzes functions of the assessment scheme from legislation,enforcement and compliance points of view.The theoretical study serves to prove that we shall study and understand the significance of the evaluation scheme from the perspective of integrated legislation in agriculture and maximizing social benefits.Chapterâ…¡discusses the basic norms in the cost-effectiveness evaluation.Based on the analysis of the principal compositions of legislative cost and effectiveness in agriculture,as well as assessment contents,categories,and entities,this paper puts emphasis on the procedure of evaluation.It paves the way for designing and developing an indicator system through the study of basic norms in the evaluation system.Chapterâ…¢focuses on the evaluation indicator system.First of all,it analyzes the principles in developing indicators.Secondly,it puts forward 6 tier-1 indicators and 12 tier-2 indicators to form the indicator system on the basis of basic evaluation norms and practical use.Thirdly,it states the use and feasibility of indicators and application of assessment outcomes. Finally,it carries out an empirical research on the indicator system though case studies.
