Study On Our People's Mediation System

The people's mediation system is a legal system with Chinese characters. It is the Confucian cultural outcome "with suit" .It is worthy homeland resource in modern process of our legal system. It originates nongovernmental mediation system of ancient China, the founding of the people mediate system has its deep economic base and cultural background .The people mediation has its important status and unique value, it is convenient,fast,and cheaply to resolve a great quantity of grass-roots disputes, well developing the function of "a defense line" of maintaining social stability, and is reputed by western scholars as "An Oriental Flower". But with the contradiction of society changing, the people's mediation is faced with the problem that has been not general but wider and involved and difficulty dissension. Therefore, the people's mediation met with a lot of pressure. Society development, legal improvement has put more expectation on people's mediation system. Therefore, bettering and developing people's mediation system has become more and more necessary.This thesis is totally divided into five parts, the basic structure is as follows: Chapter 1, by using the method of legal explanation, introduces the basic concept,characteristics and quality of people mediation, points out the people mediation important position in mediating system resolving mechanism in our country contradiction dispute.Chapter2, by using the method of history research, the author makes a brief review of the history of our people mediation system. Chapter3, According to the current situation in China , it is necessary for the existence of people's mediation system in China. Chapter4, objectively describes the predicament that our people mediation faces in the process of reformation and establishment of legal system and then analyzes the reason behind it. Chapter5, On the foundation of above research , put forward some suggestions, to endow the agreement of people mediation with enforceability in law; to expand and regulate the accepting range of people mediation cases; to construct new type of mediation organization.
