| With the continuous development of economy and society,the number of social contradictions and disputes in China has exploded.In order to realize the governance of litigation sources and relieve the litigation pressure of courts.China is committed to the construction of diversified dispute resolution mechanism.In the diversified dispute resolution mechanism,mediation,litigation and arbitration are important ways of dispute resolution.Among them,mediation has the advantages of flexibility and locality,plays an irreplaceable role in resolving social conflicts and disputes.As a county-level judicial bureau at the township level,judicial offices undertake the important functions of guiding and managing people ’s mediation and participating in the resolution of conflicts and disputes,and play an important role in grassroots social governance.With the profound changes in society,social contradictions and disputes have become increasingly complicated and diversified,showing many new characteristics and new trends,which have brought many challenges to the mediation work of township judicial offices.In this context,how to make the township judicial office better play the role of resolving contradictions and disputes and help the construction of a diversified dispute resolution mechanism is worth exploring.This paper selects the T Judicial Institute in the central region of China as the research object,and conducts a full investigation on the current situation of the mediation work of the T Judicial Institute,trying to dig out the problems existing in its mediation work and put forward corresponding suggestions.The content of this paper can be divided into the following six parts : The first part is the introduction,which mainly describes the background,research status and specific research content.In addition,the research significance of the mediation function of the judiciary is clarified from the perspectives of theory,legislation and judicature.The second part is the elaboration of the research process and research methods.The third part is the collation and analysis of the survey data.On the basis of the data,the operation status of the mediation work of T Judicial Institute is clarified.The fourth part further analyzes the problems in the mediation work of T judicial office,combines the practice and theory of T judicial office,and explores the reasons behind the problems.The fifth part is the key part of this paper,which is devoted to solving the problems in the mediation work of T judicial office,and to the future development of T judicial office. |
