China is the world's desert area, and widely distributed, one of the countries seriously harmed. At present, there are vast numbers of desertification land area each year as a result of desertification caused direct economic losses amounted to 54 billion yuan. Desertification in some areas makes production low and unstable, causing grassland degradation, weakening the effectiveness of irrigation and drainage facilities, water conservancy project, rail and road traffic congestion, dust storms, etc. Desertification has also affected people's production and living environment, people's physical and mental health. Desertification has also deepened the poverty level, expanding the gap between rich and poor areas. More pressing and urgent need to alert us that a serious desertification, land degradation, with the result that the survival of our arable land decreases. China is now under the guidance of the concept of sustainable development and under the historical background of making efforts to build an environment-friendly community and a resource-conserving society, our country as the world's most populous country, it is necessary to strengthen China's desertification legal system research, and improve China's desertification control legal system, to curb the growing desertification of our land to hold back the grim situation, maintenance and expansion of China's total area of land resources, which insists on the total amount of 180million mu of arable land red line, and ensure our country's food security and social stability, the promotion of comprehensive, coordinated and sustainable development. China as a "United Nations Convention to Combat Desertification," one of the States Parties, a positive commitment to combat desertification, for the well-being of its people and preserve the global environment of the duties and responsibilities of security has developed a package of policies and laws and regulations.This paper, in state of desertification in China's grim situation, introduces the definition of desertification, the views of different scholars at home and abroad, China's desertification causes and types of desertification control in China Legislative Overview and the question of the legal system, that is, anti-desertification law principles too, and for the protection of state-owned land not enough, the lack of coordination of environmental resource management agencies, the need to improve the property rights system with natural resources, ecological compensation mechanism for the five defects remain to be improved.For the existence of these problems, this article on desertification control study of the legal system is not designed to enact a "Law to Combat Desertification" as the special law, but the existing legislation to combat desertification and explore a number of analysis, combined with legislative experience in developed countries which are suitable for the condition of our country, improving China's legal system of desertification, namely, to enhance the practical operation of desertification and strengthen the protection of state-owned land and management, establish a sound system and public participation coordinating agency, and improve natural resource property rights system, to try and explore ways to improve the ecological compensation, improving the China's legal system of control, for China's comprehensive, coordinated and sustainable development, providing a useful point of reflection and attempt.
