Trade barriers can be defied as a series of rules, measures and technical standards, which an independent state adopts in an attempt to protect inner-state industries, laying restrictions on the international trade development. Trade barriers may appear in varied forms due to different times. With the process of trade liberation rapidly deepening, the economic globalization performs in a great speed, as brings sharp changes to people's life styles and conceptions of values. These changes consequently raise new requirements of the international trade developing pattern. Governments, therefore, come up with many new rules and policies, which contributes to new types of trade barriers, to meet the concerning requirements.Both the new types and the traditional ones aim at protecting inner-state interests. The two, however, show sharp distinctives. The new types of trade barriers are more complicated and have both evident positive and negative effects on the international trade, international economic law and the World Trade Organization. What to do with these effects has been the focus of international community in the last decade and also the main issue of this thesis. As the most important international organization in the world, the World Trade Organization can afford to efficiently settle the disputes caused by the new types of trade barriers.This thesis introduces several typical types of the new trade barriers and related WTO rules on the basis of comparison between the new and the traditional ones. Then it gives an entire discussion over the current WTO legal schemes which will play a significant role in dealing with the positive and negative effects of new trade barriers. At last but not least, the thesis provides some useful suggestions for China's trade development. |
