The Protection Of Consumers' Fundamental Rights

With the rapid development of internet in recent years, electronic commercial transactions present the trend of prosperity, and thus make positive contribution in promoting the development of modern commercial affairs. But because electronic commercial transactions have the stateless,fictitious and other characteristics, many kinds of problems and questions puzzle the consumers, and in these problems, endangering individual consumers'fundamental rights comes often. In this thesis, the writer begins his article with general discussion on the essence of electronic commercial transactions, on the individual consumers involved in and their should-be-satisfied fundamental rights,and then make deep research by the methods of illustration and deduction in the meaning,the problems,the causes to problems and the countermeasures in the consumers'such four fundamental rights as the rights to know the facts of transactions, the rights in protecting individual secrets, the rights to be safe in life and property and the rights to get compensation when rights being damaged. And from above, the writer aims to make some help and promote the healthy and effective development in giving some suggestions on making laws to protect the consumers'rights,perfecting the paten of electronic commercial transactions and fulfilling the all-round and effective protections in consumers'rights in those transactions.
