On Equal Right To Education Of Our Citizens

The education is the cornerstone of national development, the education fair is the important social justice.As a result of historical and reality reason Chinese citizens are still educated inequally and the inequalityies are very conspicuous .This paper first pointed out the reason to select the topic, the primary intention of writing and the hope in the introduction.Then the paper separately by three parts introduces the concept of equal right to education, the present situation, the reason and the safeguard measure.In partâ… ,from analizing of the concept of the right to education and its nature I analize the relations between the right to equality and the right to education, discuss the basic contents of equal right to education and the the ptency of equal right to education. Equality of the basic right to education, can be summarized as equality of owner of rights, equality of right content and equality of education effect . The ptency can be summarized as to the state,to thethird people and to the educate organ.Partâ…¡from the basic content of equal right to education I comprehensively intrduce the unequal performances on the right to education of our citizens and analize the reasones which can be summarized as the influence of traditional thought ,economical reason, reason of system, reason of policy and reason of educates corrupt. In partâ…¢,I first give an integrated evaluation of current legal provisions for protecting the the eaqal right to education ,and point out the shotcomings on legislation ,enforcement ,relief system and,surveillance ,then I intrduce the protection for the equal right to education. The safeguarding measures mainly include legislation protection,enforcement protection and Judicial Protection.On legislation we should perfect and build the non-litigation relief system including student complaints system, the education mediation system and education system of arbitration . On Judicial Protection,I think not all the right to education can be sued based on the practacal situation of China. for the relief measures, we should perfect the education litigation relief system such as constitutional litigation, civil litigation and administrative proceedings .
