Rural left-behind children mean those children lives in countryside, whose parents work in city. This phenomenon emerges with the development of national industrialization and the transfer of work force from countryside to city. Because their parents do not live them together, their legal rights are always aggrieved, and those seriously influence their life. The problem gets more and more attention. This dissertation, based on a investigation to the status of left-children rights, concludes that there are serious limitation on the protection of left-behind children rights, and brings forward several constructive suggestions to the problem.This dissertation consists of three parts; part 1 introduces the conception of left-behind children, which means fewer than 18, and then the reason of this phenomenon, which consists of the lower income the fluidity of farmer-worker, and duality census register system.Part 2 is an investigation of left-behind children' s right. Chapter 1 is a summery of the investigation, including objective,content,method and the process of implementation. Chapter 2 is the specific situation and analysis. By means of condensed questionnaire and conversation, this chapter analyses the problems ranging from their right of guardianship, right of education, right of health, right of development, right of individual security, which may have an effect on the occurrence of the problem of left-behind children. This article also analyses the situation with some cases and draws a conclusion that there' re many defects on left-behind children' s protection.Part 3 is countermeasures about left-behind children' s right protection, which is composed of 4 chapters. Chapter 1 suggests reforming the differentiated census register, and making the worker-oriented peasants and citizens enjoy equal rights, gets the left-behind children to live in town with their parents. Are then, it suggests improving the legal system of the left-children' s protection through liability of their parents. At last, it suggests revising some legal articles and improving the law suit. Chapter 2 gives some suggestions about putting more funds in education and paying more attention to the protection of the left-behind children. Chapter 3 advises schools to give this kind of children more love and pay attention to their psychological education. Chapter 4 suggests that parents should attach importance to family education, give children more love and choose persons of capacity and of morality to be entrusted guardians.
