Collision And Choice Of The Fair And Efficiency In Economic Law

After the reformation and opening up, China has experienced a period of rapid development. But this period is also one that social inequality is becoming increasingly serious, high economic growth and a widening income gap coexist. And the traditional concept of "giving priority to efficiency with due consideration to fairness" is not appropriate to requst of social development, and economic law of fair value has changed with the transformation of time .This discourse is mainly based on the status quo of China's economic law, and basically used empirical analysis and comparison of the methods to discuss that among the Economic Law ,the establishment of the priorities of fair value and the pursuit to the realization of its mechanism. And this proceeding was instructed by scientific outlook on development. The full text is divided into three parts:The first part, on the economic phenomenen of rise in ticket during China's Spring Festival,and assess the views of the parties to this incident, and its demonstration of the economic law, with emphasis on the collision between the value of fairness and efficiency arise from China's social development and in the operation of economic law.The second part discusses the definition of fairness and efficiency, focusing on meaning of fair from the perspective of Philosophy of Law and Economic Law. And pointed out that law especially economic law exists pluralism during the pursuit of its value,.The realization of the the value of equity and efficiency is accompanied by the collision of fair value and efficiency value , the priority should be chosen fair, balanced efficiency when face such conflict.The third part, from China's social and economic development process of their own historical perspective and the the development of economic law along with its inherent perspective to the analyse the inevitability for China at this stage to put fairness on priority on the economic law field, mainly expound that such priority is conform to the intention of the scientific outlook on development. And finally conclude with a proposal for mechanism to achieve fair value in Economic Low.
