| Drinking water is the basic need of human existence. It concerns the health of the masses whether drinking water is safe. But unsafe condition of drinking water exists in China. Water is short in some regions. The pollution of the drinking water source is deteriorating in some cities. In some countryside regions the drinking water lies in the problems such as bitterness and saltiness, high-fluorine, high-arsonium, and bloodsucker pathogens, which threaten the people's health seriously. These have become outstanding environmental problems and social problems.Comparative law science is the visual field of this paper. In order to supply some experience to better settle the existing problems in the theory and practice of drinking water safe legal guarantee, the safe legal guarantee problems of Sino-American drinking water are studied and compared.Some research methods are used in the paper, such as comparative method, positivism method, norm method and historical analysis method. With the train of thought of bringing up problems, analyzing problems and solving problems, I attempt to plainly inquire into the legal guarantee problems of safe drinking water Between USA and China. Some relevant problems of drinking water safe legal guarantee is initially expounded in this paper to explicit the meaning of the safety of drinking water and discuss the importance and feasibility of guaranteeing the safety of drinking water. Next the legal systems of Sino-American drinking water safe legal guarantee are studied comparatively. And found the legal gap and shortage existing in the legal systems structures of Sino-American drinking water safe legal guarantee. Then the relevant problems of the safe legal guarantee of Sino-American drinking water are compared, among which the management systems, the basic systems, the legal liabilities are compared emphatically. On the basis of it some existing problems of drinking water safe legal guarantee are found. In the end, aiming at the existing problems of relevant legal systems and relevant content in our country, the perfection suggestions of the relevant problems of drinking water safe legal guarantee in our country are put forward subsequently. My suggestion is to perfect the legal systems, management system and basic systems of drinking water safe legal guarantee in our country on the premise of establishing the guideline and basic principles of drinking water safe legal guarantee.
