Objective: To expound fitting grading in civil litigation competence, explore the influencing factors of mental disorders'civil litigation competence, and create an instrument to determine the mental disorders'civil litigation competence. In the end, to establish a judge instrument which is systematic, correct, objective and consistency.Methods: Integrating the Civil Procedure Law of the People's Republic of China and the authors'forensic psychiatric experience, making the fitting grading in civil litigation competence definitely . Compile a questionnaire of civil litigation competence, then scaling the object with RTHD, and ask all object complete the questionnaire. Investigate influencing factors of civil litigation competence. Create an instrument which called the Mental disorders'Civil Litigation Competence Rating Scale, then use the instrument retrospectively and to study the validity and reliability of the instrument.Results: (1) Civil litigation competence was divided into two grading. According to the logistic regression analysis, the impact of influencing factors followed by large to small are wade to tell an item, sue for, litigation position, contact the agency, verdict performance, the verdict reply, the intermediation handle, court to argue, hand over the statement, discuss litigation, motion control, court of the proof, insight, social function etc. (2) Using the instrument retrospectively and to study the validity and reliability of the instrument. Split-half and homogeneity reliability of the instrument is 0.9801 and 0.9805 respectively, the correspondence of the conclusion between the instrument and the expertise is 0.8169.The overall hit rate was 78.315%,the items'correlation coefficient of rating scale is between 0.531 to 0.681(p=0.000).There is high coherence(kappa is between 0.50 to 0.90,p<0.05=. We can get two factors which are identity and control competence, and the overall hit rate is 75.297%. There is 94.0% correctly divided. (3)After cross-sectional study , the items'correlationcoefficient of rating scale is between 0.396 to 0.768(p=0.000) and retest reliability is 0.982. There is high coherence(kappa is between 0.50 to 0.91,p<0.05=. We can get two factors which are identity and control competence, and the overall hit rate is 78.315%.There is 94.7% correctly divided.Conclusions: (1) The influencing factors are litigation position, wade to tell an item, sue for, contact the agency, discuss litigation, hand over the statement, court of the proof, court to argue, the intermediation handle, the verdict reply, verdict performance, motion control, social function, insight etc. (2) According to retrospective study, the validity and reliability of the instrument is good. (3)The Mental disorders'Civil Litigation Competence Rating Scale is feasible.
