A View About The Efficiency Value Of Law

The efficiency value of law is an important basic category of law subject. Efficiency value reflects the relationship between input & output or cost & income. The efficiency value of law means that law could be made to put in little while gain more in order to meet public needs in law field. Nowadays, more and more law scholars have been researching the efficiency value due to its significance and it did not arouse enough attention of public in our country.Efficiency is always related to justice. So my thesis compared with efficiency and justice when touching upon the position of efficiency value of law, and explained its relationship and importance. The argument between efficiency and justice bothered people in a long time, while how to make the choice become the most difficult problem. How to ensure efficient priority and realize justice is an important task.We should think much of the significance of efficient priority under the low economic state in our country. It is the similar reason in law. Its need payment in legislation, enforce the law, judicature, keep the peace, implementation of new law and appellate court. All these could consume social cost. There is a basilica theoretic and practice significance in how to carry out efficiency value during the operation of law. At present, we still lack the thorough research about efficiency value. Law should regard efficiency as the value orientation to fair distribute limited social resources; law scholars are also carrying out research based on efficiency.
