Study On China's Core Values Of Law In A New Period

The party's 16th plenary of sixteen session has put forward the important task of "To Construct the Core Value System of Socialism" for the first time,and the essence of constructing the core value system of socialism is to construct the core values.The core values is the most basic and main values that is identified with the most members of our society,which is proposed by a particular country's decision makers.To construct the core values,it must insist on the unification of the realistic rationality and the historical rationality,it must contain the universal value,it must be based on the traditional culture details,and it must be accord with the advanced leading group's political,economic and cultural idea.To correspond with it,the core values of law is the values which plays a dominant role in core values system of law.The core values of law is the unification of the core and the diversity,and has specific interests and compulsory.The basic principles of constructing the core values of law is that insisting on using scientific development view and the theory of constructing socialist harmonious society,which is the latest theoretical achievements of Marxism and Marxism in china,to guide the construction of the core values of law,insisting on using reformative and innovative spirit of times to guide the construction of the core values of law,and the construction of the core values of law should use the universal values of law for reference.In a new period,the basic content of the core values of socialist law should be Human-oriented,Stability and Order,Fairness and Justice and Environmentally Friendly.Human-oriented is the starting point and essential requirement of the socialist law;Stability and Order is the basic function and basic value of the socialist law;Fairness and Justice is the fundamental spirit and fundamental principles of the socialist law;Environmentally Friendly should be a new value idea of the socialist law,especially for the resources and environment law.This paper starting from the connotation and content of values,the connotation and construction principles of the core values has been analyzed,the connotation, characteristics and function of the core values of law has been discussed,to the basic content and characteristics of the foreign law values and the core values of foreign law has been traced back,and finally,some basic principles and assumption of the construction of the core values of law in china has been put forward tentatively.The innovations of this paper are listed as follow:based on the analysis of the academic circles' study achievements,the standard of the judgment of core values and the connotation of core values has been put forward,the basic content of the core values of socialist law has been discussed,and the assumption of constructing the core values of law has been put forward.We hope that more attention will be paid to the core values of law and some contribution will be provided for the socialist harmonious society.
