Chinese legislation of animal protection has only just started, and has already attracted national and international attention. This article is talked about the animal protection in Chinese law, and to present the legislative proposals.This article is consisted of seven parts. The first part is a introduction; The second part discusses the ideological foundation for the protection of animals; The third part reviews the practice of the animal protection legislation, and compares the Chinese legislation with the foreign legislation; Part IV investigates the need to strengthen Chinese animal protection legislation; The fifth part bring forward a plan of legislation; The sixth is a draft of "Protection and management for stray cats and dogs in cities act" which is worked out by the author; The seventh part is the conclusion.This article firstly discusses the main viewpoints of the religions and in the philosophy history on animal protection. Buddhism, Christianity, Taoism and Confucianism, all of these great religions eliminate evil, advocate caring, compassion and love. The value of animal life has been given varying degrees of importance. All of these religions are positive forces for the protection of animals. The various viewpoints in the history of philosophy also reveal the complex relationship between animals and people. The author agrees with the point of the Buddhism on animal protection.This article then recalls the practice of animal protection legislation. Western animal protection legislation started in 1800, in many countries it has formed a relatively complete system. Compared with them, Chinese animal protection legislation is backward, relevant legislation is enacted to protect the interests of the people, but not the animal. China is in urgent need to establish real animal protection laws.Among the fourth and the fifth parts ,this article discusses the urgent need to enact laws to protect animals, and bring forward ideas of legislation. These ideas include the legislative routes, intention, steps as well as some technical issues' resolution.As the author participates in the animal protection activities in practice, upon these experiences the author tries to institute a draft of "Protection and management for stray cats and dogs in cities act". The sixth part includes 23 provisions of the draft and the legislative description , reasons and reference cases.The final part is the conclusion.
