The Establishment And Improvement Of The Legislation On Our Country Telecom Service Under GATS' Frame

With the coming of the information society the trade in telecom service is more and more important between nations. Information and the facilities for accessing and transmitting has become into the strategic resources as important as soil, labor force and capital. The trade in telecom service is the main part of the frame of WTO's service trade. It develops more rapidly in foreign trade in recent years. In the information society, the international telecom trade has penetrated into the all aspects of the international economy, politics and culture-exchange.There are four parts in this thesis. The first part is about "The basic frame of the trade in telecom service ", which is the general introduction of the GATS's trade in service. This part includes: (1) the general introduction of the telecom and the legislation on telecom service; (2) the telecom service and the trade in telecom service under GATS's frame; (3) the agreements in connection with GATS's trade in telecom service;. The second part is about "The development of the telecom service industry of our country and its current legislation". This part includes: (1) the development and present situation of the telecom service industry of our country and its problems; (2) the current situation of the legislation on telecom service and its problems. The third part is to analyze the the legislation on the telecom service industry of the main foreign country. The part includes: (1) the general introduction of the legislation on the telecom service industry of the main foreign country; (2) the main problems in the legislation on the telecom service industry which foreign country pay attentions to. The fourth part is to propose the corresponding countermeasure that our country should adopt aiming at problems mentioned in the third part. This part involves: (1) the basic principle of the legislation on the telecom service industry; (2)the legislation of the telecom service industry should adapt to the international legislation trend;(3) to improve the trade supervision system of the telecom service industry ;(4) to establish our legislation system of telecom service according to GATS. This thesis is only the author's some superficial understanding. And the author hopes that the thesis can provide the reference to improve the legislation system of the telecom service industry. This effect is also the author's wish.
